On June 21, 1982
Yogi Bear’s
Jellystone Camp-Resort filed
a petition for variance from Rule 1201 of Chapter
3:
Water Pollution.
That petition is insufficient in that hearing
is neither waived
nor requested pursuant to Procedural Rule 401(b).
The Board notes
that if hearing is waived, such waiver must be accompanied by an
affidavit attesting to the truth of the facts alleged.
Further,
the Board requests more information regarding the discharge point,
the operator’s experience, data concerning effluent quality, the
environmental impact and the status of the Camp—Resort’s NPDES
Permit
Procedural
Rule 401(a)~
Unless the Camp-Resort files an amended petition curing the
above—noted defects within 45 days of the date of this Order, the
petition will be subject to dismissal,
