    This matter
    is before the Board

    to amend administration citation
    (complaint)

    dismissing one of
    three
    alledged
    violations
    filed
    by
    the
    Illinois
    Environmental
    Protection Agency.
    In support of its motion the Agency states that
    the administrative citation process
    is not the appropriate method
    to address the violation in Paragraph A(ii) and asks that Paragraph
    A(ii)
    be
    stricken.
    The
    Agency
    further
    states
    that
    the
    civil
    penalty
    for Paragraphs
    A(i)
    and A(iii)
    has already been remitted
    to the Agency by the Respondent.
    The
    Board
    hereby
    grants
    the
    Agency’s
    motion
    and
    strikes
    Paragraph A(ii)
    from the complaint.
    The petition for review with
    respect
    to
    Paragraph
    A(ii),
    filed
    by
    the Respondent,
    is
    hereby
    dismissed as moot.
