ORDER OF THE BOARD

This matter comes before the Board upon
a motion to withdraw
filed by the Illinois Environmental Protection Agency
(Agency) on
September
8,
1989.
In support of
its motion the Agency states
that settlement negotiations have resulted in
“a cleanup of the
subject open dump, permanent closure of the open dump, and
implementation of measures
to prevent reoccurrence of open
dumping”.
The Agency’s motion to withdraw
is hereby granted and
this matter
is dismissed.

41 of the Environmental Protection Act,
Ill.
Rev.
Stat.
1987 ch.

1041, provides for appeal of final
Orders of the Board within 35 days.
The Rules of the Supreme
Court of Illinois establish filing requirements.
