ORDER OF THE BOARD

On July
19,
1989,
the Illinois Environmental Protection
Agency (Agency)
filed a Motion
to Amend Complaint on
its Face.
The Agency requests that the administrative citation
in this
matter be amended by deleting paragraph A(ii) which alleges
violation of Section 21(q)(4)
of the Environmental Protection Act
(Act).
Correspondingly the Agency also seeks that the requested
civil penalty be reduced from $1000
to $500.
The Agency states that it has been able
to “negotiate a
quick cleanup of the open dump, permanent closure of the site,
implementation of measures to prevent reoccurance of open dumping
in the area, and an agreement by the respondent
to pay the $500
civil penalty....”
The Agency further asserts
that “the public
interest
is better served if a portion of the requested civil
penalty were to be used to help correct the pollution problem and
thereby enhance the environment”.
The Agency’s motion
is granted, and the administrative
citation
is amended as requested.
