This matter comes before the Board upon
a June
13,
1989
motion
for extension of completion schedule and variance
filed
by
IBP,
Inc.
(IBP).
IBP states
that the up—grading
of
its facility,
which has previously been addressed
in this docket by Orders
of
February
25,
1988 and November
29, 1989,
has been
further delayed
by factors beyond its control
including,
but not limited
to:
1.
Necessary
equipment
(pumps)
for
the
facilities
upgrade
have
not
yet
been
delivered
even
though
contracted
for
delivery
on
April
28,
1989.
The
pump
manufacturer
currently estimates earliest
shipment date of this necessary equipment
between June 15 and July
7,
1989.
2.
It
will
be
impossible
for
Petitioner
to
complete
construction
of
the
upgraded
facilities prior
to June
30,
1989 without
said
equipment.
Petitioner
has
investigated
purchase
of
equivalent
equipment
from other
sources
but
can not
achieve
delivery
from any supplier
prior
to June
30,
1989,
due
to the specialized
nature of the equipment.
As
a result,
IBP requests that
tfle Board extend the compliance
schedule contained
in the Board’s Orders of February 25, 1988
and
November
29,
1988 until
~ugus~
~5, 1989.
On June
14, 1989,
the T1~inois Environmental Protection
Agency
(Agency) filed
a response
to IBP’s motion.
The Agency
states that
it does not object
to the extension of
the compliance
date
to August 15,
1989
as
it appears that
the delay
is
caused
by
circumstances beyond
the control
of
IBP.
