ORDER OF THE BOARD
(by Mr. Werner):
On March
9,
1979, the Hearing Officer granted the Petitioner’s
Motion to Incorporate the Record of R78-l2
(the related PPG
Industries’ proposed rule—change proceeding)
into the record of the
Variance proceeding PCB 78-210.
On April
9,
1979,
the Illinois
Environmental Protection Agency
(“Agency”)
filed a Motion to Correct
the Record requesting that only the transcript of the hearing
conducted in R78-l2 and exhibits admitted at that hearing be
incorporated
in the record of PCB 78-210, and not the entire record
of R78-12 on the grounds that it has always been the intention of
the parties
in this case to place before the Board only the transcript
of the hearing
in R78-l2 and the exhibits admitted at that hearing
in R78-l2.
Additionally, the Agency has stated that the record in
this case will be submitted to the United States Environmental
Protection Agency
(“USEPA”)
as a revision to the Illinois implemen-
tation plan along with several other proposed revisions and it
is
a goal of the Respondent to make such submittals as concise as
possible.
The Agency’s Motion to Correct the Record also contains
an affidavit which states,
inter alia,
that the Petitioner’s
attorney has agreed that only the transcript of the hearing in
R78-l2 and the exhibits admitted at that hearing should be a part
of the record of this proceeding.
Accordingly, the Board hereby grants the Respondent’s Motion
to Correct the Record and orders that only the transcript of the
hearing conducted in R78-12 and exhibits admitted at that hearing
be incorporated
in the record of the proceeding
in PCB 78—210 and
not the entire record of R78-l2,
