ADOPTED RULE
ORDER OF THE BOARD
(by D. Anderson):
On May 5,
1983 the Board proposed
35 Ill. Adm. Code
304.205,
a site-specific effluent rule for John Deere
Foundry.
The proposal appeared at
7 Ill. Reg.
6697, May 27,
1983.
On July 26,
1983 the Board sent the proposal to
second notice with no changes.
On September
22, 1983 the
cioint Committee on Administrative Rules indicated that it
had no objection.
The Board will therefore adopt Section
304.205 as proposed.
The complete text is as follows:
Section 304.205
John Deere Foundry Discharges
a)
This Section applies to existing effluent discharges
from an existing nodular iron foundry owned by
Deere and Company which discharges to tributaries
of Sugar Creek in Sections
29 and 30, T18N, R1E of
the Fourth Principal Meridian, Rock Island County.
b)
If paragraphs
(c)
and
(d)
are met, such discharges
shall not be subject to Section 304.105 as it
applies to the following water quality standards:
1)
35 Ill. Mm. Code 302.211(c);
2)
35 Ill. Adm.
Code 302.211(d);
and,
3)
35 Ill. Adm. Code 302.208 with respect to
total dissolved solids and iron
(total).
C)
No person shall cause or allow temperature in any
effluent discharge subject to this Section to
exceed 37 degrees C
(98 degrees
F)
at any time.
d)
No person shall cause or allow the concentration
of total dissolved solids
(STORET 70300)
in any
effluent discharge subject to this Section to
exceed 2200 mg/l,
subject to the averaging rule of
Section 304.104.
