AND
ORDER OF THE BOARD

This matter is before the Board upon a Petition for Extension
of Variance by the Flintkote Company
(Flintkote)
for its felt mill
in
Mt.
Carmel, Wabash County,
Illinois.
The previous variance was
granted in PCB 75-381 by an Opinion and Order of the Board dated
January
8,
1976 and modified February
19,
1976.
The Illinois Environ-
mental Protection Agency
(Agency)
filed an Objection
to the Petition
for Variance on September
13,
1976 and filed a Recommendation October
26,
1976.
Hearing was held
in the matter on December 14,
1976.
No
public
comment
has
been
received by
the
Board.

Generally,
Flintkote
is
in the process
of implementing
a total recycle system in lieu of its prior discharge
to the Wabash River.
Flintkote originally discharged
500,000-700,000
gallons per day of effluent, adding 3600 pounds of BOD5 and 4000
pounds per day of suspended solids to the Wabash River.
Presently
Flintkote
is
discharging on the average about 17,200 gallons per day
containing about 44 pounds per day of suspended solids and 760 pounds
per day of BOD~.
In
the variance granted
in
PCB 75-381 Flintkote was

to cease all discharges other than non—contact cooling water on or
before September
1,
1976.
Due to additional equipment found necessary
subsequent to the Board Order in PCB 75-381 and the inability of the
Envirex Company
to supply a rake mechanism previously ordered, Flint—
kote now proposes a time schedule for bringing the plant into com-
pliance at zero discharge which calls for a January
1,
1977 completion
date and a February 28,
1977 final evaluation date of the system.
In
addition Flintkote requests much wider limitations be set on its
effluent since it has been unable to meet the effluent limitations set
by the Board in PCB 75-381.
The Board finds from the evidence that Flintkote has proceeded in
good faith in this matter.
It is acknowledged that this is an experi-
mental
installation which Flintkote has pursued slowly but with great
care.
The Board will accept the delay in the final execution of the
zero discharge process due to
a change in design subsequent to the
compliance dates set by the Board in PCB 75-381 and the delay
in
delivery of equipment.
The variance in PCB 75—381 will, therefore,
be extended until March 1,
1977, with certain minor modifications.
This Opinion constitutes the findings of facts and conclusions
of law of the Board
in this matter.
ORDER
It
is the Order of the Pollution Control Board that the Flintkote
Company be granted variance for its discharge of process waters at the
Mt. Carmel facility from Section 12(a)
of the Environmental Protec-
tion Act as
it relates to BOD and suspended solids standards,
from
Rule 404(a),
and from Rule 408(a)
of the Board’s Water Pollution Control
Regulations as
it pertains to cyanide, until March
1,
1977, subject to
the conditions imposed by the Board Order of January
8, 1976 as modi-
fied by the Board Order of February 19, 1976 in PCB 75—381, except:
paragraph
1(c)
is hereby modified as follows:
(ii)
50 pounds per day of suspended solids as
a daily average
and
Within 35 days after the date of the Board Order herein the
Petitioner shall execute and forward to both the Illinois Environ-
mental Protection Agency, 2200 Churchill Road, Springfield,
Illinois
62706 and the Pollution Control Board a Certification of Acceptance
and agreement to be bound to all terms and conditions of this Opinion

and Order.
The form of said certification shall be as follows:
