In response
to
a Motion
to Dismiss
filed
by the Illinois
Environmental Protection Agency on November 17,
1988,
the Board
hereby notes
that the Petition for Variance
filed with
the Board
on September
20,
1988
in the above captioned
case
is deficient
in
that
it fails
to:
1.
Request
a variance for
a specific time
period,
2.
Set forth
a time table to come
into
compilance,
3.
Set forth
a compliance plan,
4.
State
the present method
of disposal of
the explosive contaminated waste,
to
include costs of said disposal,
5.
Address
the issue
of arbitrary or
unreasonable
hardship,
6.
Address
the issue of consistency with
Federal
Law.
The Board vacates
it order of October 20,
1988
to await
the
recommendation
of the Agency and enters
a more information order
to have the Petitioner
address
the deficiencies
listed above.
Unless
an amended petition
is filed within
45 days
of the date
of
this Order, curing the above—noted defects,
this matter will
be
subject
to dismissal, pursuant
to
35 111.
Adin. Code 104.125.
When
a sufficient
amended petition has been received by the
Board,
the statutory decision deadline will restart.
