1988, has requested the Board
to modify
its Opinion and Order of January 23,
1986.
Marathon cites the
continued pendency of
its petition for
a site—specific rule
change
in R87—2
in support of its motion.
The September
19,
1988
response indicates that the Illinois Environmental Protection
Agency
(“Agency”)
does not object to the requested modification
of the January 23,
1986 Opinion and Order.
For
the foregoing reasons, the paragraph numbered
“4” on
page
7
(67 PCB 519)
of the Opinion and Order
of January 23,
1986
is hereby modified to read as
follows:
4.
Should
the
Board
deny
the
Marathon—
requested
relief
in
the
site—specific
rulemaking
proceeding
docketed
as
R87—2,
Marathon
shall
submit within
60
days
of
such denial,
a plan
to the Agency to come
into
full
compliance
by
the
expiration
date of the variance.
This Supplemental Order modifies no other portions of the
January 23,
1986 Opinion and Order of the Board.
