ORDER OF THE BOARD (by M. Nardulli):
On August
15,
1988, the Attorney General, on behalf of the
People of Illinois, filed a Motion
to Dismiss.
In the interest
of expediency and to settle this matter,,
the Agency caused
a
Complaint to be
filed in the Circuit Court of Cook County,
Illinois, Chancery Division, on July 27,
1988, which mirrors the
allegations
of the Complaint filed with the Board on January 11,
1988.
On July
27, 1988,
the Honorable Roger J.
Kiley,
upon
stipulation and agreement of all
interested parties, approved and
entered a Consent Decree for the purposes of settlement and
disposing
of all matters of dispute.
In order
to avoid duplicity
of adjudication and as all matters of dispute have been disposed
of by the aforementioned Consent Decree,
it is necessary that
the
pending Complaint of January 11,
1988 be dismissed.
This motion
is granted and the matter
is hereby dismissed.
