This matter
comes before
the Board upon Respondent,
Elizabeth Street Foundry’s,
August
2,
1988,
filing of
a Motion
requesting an extension of time
in which
to comply with this
Board’s Order of March
24, 1988.
Complainant objected,
by
motion,
on August
8,
1988.
On March
24, 1988,
this Board ordered Respondent
to contact
the Illinois Department of Commerce and Community Affairs
(IDCCA)
and seek other available governmental assistance
for conducting
a
stack
test at Respondent’s facility.
Respondent was ordered
to
seek assistance
in financing and obtain technical advice
concerning possible plant modifications and pollution control
equipment.
Respondent’s Motion avers an attempt
to comply with the
Board’s Order
in all respects, including
a review of
20 programs
available through IDCCA,
a real estate appraisal an~consultation
with
the College Of Engineering at the University Of Illinois.
Respondent urges
the Board
to grant additional
time to allow
university personnel
to analyze
the circumstances and file a
detailed report.
Complainant objects stating that Respondent
never
communicated or contacted the Illinois Environmental Protection
Agency after
the Board’s March 24,
1988 Order.
Complainant
also
attacks Respondent’s supporting documentation and affidavits
characterizing these
as purely speculative and wholly
inadequate.
Complainant urges
the Board
to reject Respondent’s
Motion and enter,
inter
alia,
a cease and desist order.
The Board does not agree
that the Motion and supporting
documents are speculative and
inadequate.
These indicate
a
effort
to comply with the March 24,
1988 Order; matters beyond

Respondent’s control should not be allowed
to
prejudice
Respondent’ s case.
The Board does hereby grant Respondent’s Motion;
the filing
deadline
is extended until November 14,
1988.
