HEARING OFFICER ORDER
On August 25, 2005, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that they are discussing minor language in the
stipulation and proposal for settlement (stipulation), and that the complainant will forward a
revised stipulation to the respondent for review. Respondent is given to November 14, 2005, to
replead its affirmative defense to
laches
, if needed, and the complainant is given to November
30, 2005, to answer respondent’s affirmative defense number 2 not addressed in the Board order
of March 4, 2004, if needed.
The parties are directed to participate in a telephonic status conference with the hearing
officer on October 27, 2005, at 9:15 a.m. The status conference must be initiated by the
complainant, but each party is nonetheless responsible for their own appearance. At the status
conference, the parties must be prepared to discuss the status of the above-captioned matter and
their readiness for hearing. If, however, a stipulation is filed prior to the next status conference,
the conference will be cancelled without further order.
