ORDER
OF
THE
BOARD

Mr.
Goodman):
On
April 11,
1977,
Respondent filed a Motion,
requesting the
Board to rescind its March 17,
1977 Order herein and further
requesting the Board to stay any action on this enforcement case
until the Board promulgates particulate and sulfur oxide emission
limitations applicable to Respondent’s facilities.
The Agency,
in
a response dated April
18, 1977,
opposes
a stay of the proceedings,
but requests modification of the Board’s March 17 Order such that
additional time be allowed to enable the parties to complete
discovery.
On April
14,
1977,
the Board revoked its March 17,
1977
Order.
The Board finds that no stay
is warranted herein,
and, there-
fore, we will deny Respondent’s Motion.
However,
in accordance with
the parties’
request, we will order that hearings in this matter be
set within 90 days of the date of this Order.
