DOUGLAS

MORING, ASSISTANT ATTORNEY GENERAL,
APPEARED FOR
THE ENVIRONMENTAL PROTECTION AGENCY
OPINION AND ORDER OF
TIlE BOARD
(by Mr.
Duinelle)
A petition for extension of a variance previously granted
by
the Illinois Pollution Control Board on March
8,
1973, PCB 72-495,
was filed on July
6,
1973.
The Environmental Protection Agency
(Agency)
filed a recommendation approving the granting of the
extension on August
7,
1973.
Petitioner owns
a copper base alloy smelting and refining
facility located in Cook County,
Illinois.
Petitioner received a
variance to exceed the particulate emissions limitations until
June
30,
1973,
in order to allow the installation of
a baghouse
to control particulate emissions.
An extension of that variance
is now sought until September 26,
1973 to correct mechanical
problems which have
become apparent during the early periods
of
operation of the baghouse facility.
These mechanical difficulties
are caused by the installation of an undersized compressor
and
conveyor system.
Both pieces of equipment are under warranties
and will be replaced with proper sized equipment.
The Agency states
that the Petitioner has met all
of the con-
ditions specified
in the previous order of the Board
(PCB 72-495)
and
that correction of the above two problems will allow compliance
with particulate limitations.
The Board finds that Petitioner has
made satisfactory progress
in abating its particulate emissions.
