EMISSION STANDARDS
ORDER OF THE BOARD
(by Mr. Henss):
On July
16, 1975 the United States Steel Corporation
filed “Motion fo~ Stay” requesting the Board to stay the
effectiveness of certain rules and regulations which had
been adopted by the Pollution Control Board over three years
earlier on April
13,
1972.
United States Steel Corporation
is seeking judicial review of the Regulations and its Petition
for Review
is presently pending in the Appellate Court of
Illinois.
Presumably,
Petitioner’s Motion for Stay would be
for the duration of judicial review and could encompass
an
indefinite extended period of time.
We are not inclined to grant such a delay in pollution
control for the state of Illinois.
The request for delay is
too broad and indefinite for approval of this Board.
A similar
request by United States Steel was denied by the Board on
July
26,
1973.
It is entirely possible that particular
situations might arise while a matter is pending on review
which would make it unreasonable for a prosecution to proceed.
We believe, however, that any such situation will have to be
clearly specified
arid that the stay will, of necessity, be
limited in scope.
Only vague conclusions
and generalities
are offered in supp3rt of the current motion.
