ORDER OF THE BOARD

This matter comes before the Board upon
a Motion to Dismiss
Complaint filed June 4,
1987, by the City of Kewanee
(City) and
as
a result of a Motion
to Continue Hearing filed on June 8,
1987,
also by the City.
The Motion to Continue Hearing was filed
with the Hearing Officer, who granted
the motion and continued
the hearing until
further
order
of the Board.
In its Motion
to Continue,
the City alleged that it intended
to adopt
at its June
10,
1987, City Council meeting
an ordinance
that would comply with the provisions of the Illinois
Environmental Protection Act and
the
Rules of the Pollution
Control Board.
Based
in part on this allegation, the Hearing
Officer
granted the Motion to Continue.
The Board, however, has
not received any information as to whether the City has,
in fact,
amended its ordinance.
The Board
believes that this information
is necessary to adequately consider the pending Motion
to
Dismiss.
Therefore,
the Board requests the parties
to submit
additional information regarding
(1) what action,
if any, the
City Council took toward amending its Ordinance,
and
(2) what the
parties’
intentions are as to further proceedings
before the
Board,
i.e.
is the amendment,
if any, satisfactory to the
Complainant?
The parties are requested to respond within
15 days of the
date of this order.
Ruling on Respondent’s Motion to Dismiss is
accordingly postponed until such time as the Board
is notified of
this information.
