    the BOARD (by Mr.

    This
    is
    a petition for variance from the Village o~Carrier Mills for
    relief from the O~O2rig/I
    standard for copper in Chapter 3, Rule 203
    (f)
    of the Board~sWater Pollution Regulations,
    in order to apply copper sul-
    fate as an aigicide in its water storage reservoir.
    Petitioner orginally
    filed on October
    7,
    1974, and re-filed with additional
    information,
    pursuant
    to Board order,
    on November
    1,
    1974.
    The variance requested was for one treatment
    in 1974 and four treat-
    ments
    in
    1975,
    as follows:

    The Agency estimates that for the 100
    lb. dosage per treatment by the pet-
    itioner in
    its
    11,000,000 gallon reservoir,
    the copper sulfate levels should
    not exceed 0.27 mg/i.
    Carrier Mills had previously received
    a variance
    in PCB 73-131
    on June
    14,
    1973 for the same purpose.
    The Agency Recommendation, filed
    on December
    5,
    1974, would allow the
    variance, but limit the dates and amounts
    of dosage to two treatments of one
    hundred pounds each
    in 0ctobe~ and November, 1974
    The Agency notes the ser-
    iousness of the algae problem for public water supplies and the lack of ade-
    quate alternate treatment methods,
    as nac this Board

    On November 22, 1974,
    the Board adopted Chapter 6, Public Water Sup-
    plies
    (R 73-13).
    Rule 203 of that Chapter now governs
    the use of copper
    sulfate in public water supplies, and requires
    a public water supply op-
    erator to secure a permit from the Agency.
    This rule now being
    in effect,
    those portions of the petition relating to treatments
    in 1975 will te dis-
    missed as moot,
    and petitioner Carrier Mills advised to seek the proper
    permit.
    As
    to the variance request, by Carrier Mills for a November 15,
    1974
    copper sulfate treatment, neither petitioner nor the Agency have made any
    indication of whether said treatment was in fact performed.
    Without such
    information, the Board will
    not address itself to that issue,
    This Opinion constitutes
    the findings of fact and conclusions of
    law of the Board.
    ORDER
    IT IS THE ORDER OF THE POLLUTION ‘CONTROL BOARD THAT:
    1.
    Those portions
    of
    this petition applying to copper sulfate treat-
    ment in 1975 are dismissed as moot.
    2.
    That part of this petition applicable to November 15,
    1974 is dis-
    missed without prejudice.
