Pursuant to an Objection and Motion for Hearing filed by
Respondent Environmental Protection Agency on November
16,
1976,
the
instant matter had been set for hearing.
Subsequently, on
January
5,
1977, after receipt of the Agency’s Recommendation,
Petitioner filed the instant Motion for Entry of Order Based on
Recommendation.
On January
11,
1977,
~he
Agency
filed
for Leave
to withdraw
its Objection,
etc.;
the Board hereby grants this
Motion.
Havincj reviewed the pleadings in the matter,
the Board finds
that the record presently contains sufficient facts
to form the
basis of
a decision on the Petition.
We accordingly vacate our
earlier Order requiring
a hearing,
and shall enter a final Opinion
and Order based on the present Record.
