a petition for a variance from Rule 702 of Chapter
3:
Water
Pollution,
the sewer discharge criteria for mercury.
Pending
before the Board is a proposal to modify Rule 702
(R76—21,
Second
Notice Order, August 20, 1981Y~ The proposal would change the
discharge standard to 0.003 mg/i under certain conditions which
may be applicable to Petitioner,
It
is possible that this will
he adopted and effective prior to final action on this variance
request.
The Board asks that Petitioner review the proposed rules
and indicate the effect on the variance request if adopted.
The
petition includes a waiver of hearing but not the affidavit
attesting to material facts required by Procedural Rule 401(h).
The matter will be subject to dismissal unless an amended petition
addressing the noted deficiency is
filed within 45 days of the
date of this Order.
The decision period
will
commence with the
filing of a sufficient amendment,
