    HEARING OFFICER ORDER
     
    On May 4, 2004, the parties participated in a telephone status conference with the hearing
    officer. The parties are awaiting the Board’s ruling on their motions for summary judgment,
    which may be decided on May 20, 2004. If the Board does not decide this matter at its meeting
    on May 20, 2004, or the Board denies both parties’ motions, petitioner should be prepared to
    agree to an additional waiver of the decision deadline at the next status conference.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 10:30 a.m. on May 27, 2004. The status conference shall be initiated by the petitioner.
    At the status conference, the parties must be prepared to discuss the status of the above-captioned
    matter.
     
    The current statutory decision deadline in this case is August 19, 2004.
