FACTS
1.
That Richard
Holmes, d!b/a
Rich’s Towing, and
Linda Holmes (“Respondents”) are
the present owners and operators of a facility located at the intersection of US 51
and Airport Road
in Murphysboro,
Jackson
County,
Illinois.
The address
is 56 Airport
Road,
Murphysboro,
Illinois.
The
property
is
commonly
known
to
the
Illinois
Environmental
Protection
Agency
as
Murphysboro/Rich’s Towing.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection
Agency Operating
Permit and is designated with Site Code
No. 0778015030.
3.
That Respondents have owned and operated said facility at all times pertinent hereto.

4.
That
on
March
30, 2005,
Garrison
Gross
of the Illinois
Environmental Protection
Agency’s Marion
Regional Office inspected the above-described facility.
A
copy of his inspection
report setting forth the results
of said inspection
is attached hereto and made a part hereof.
VIOLATIONS
Based upon direct observations made by Garrison Gross during the course of his March 30,
2005
inspection
of
the above-named
facility, the
Illinois
Environmental
Protection
Agency
has
determined that Respondents have violated the Illinois Environmental Protection
Act (hereinafter,
the “Act”) as follows:
(1)
That
Respondents
caused
or
allowed
the open
dumping
of waste
in.a
manner
resulting
in
litter,
a
violation
of
Section
21(p)(1)
of
the Act,
415
ILCS
5/21(p)(1)
(2002).
CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5!42(b)(4-5) (2002),
Respondents are
subject
to
a
civil
penalty
of
One Thousand
Five
Hundred
Dollars
($1,500.00)
for
each
of the
violations
identified
above,
for
a total
of
One Thousand
Five
Hundred
Dollars
($1 ,500.QQ).
If
Respondents
elect
not
to
petition
the
Illinois
Pollution
Control
Board,
the
statutory
civil
penalty
specified above shall be due and payable no later than June 15,2005, unless otherwise provided by
order of the Illinois
Pollution
Control
Board.
If Respondents elect to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board
in accordance with Section 31.1
of the Act, 415 ILCS 5/31.1(2002), and
if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatoryhearing,
Respondents shall be assessed the associated hearing costs incurred
by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board.
Those hearing costs shall be assessed

in addition
to
the One Thousand
Five Hundred
Dollar ($1 ,500.00) statutory civil penalty for
each
violation.
Pursuant to Section 31.1 (d)(1) of the Act, 415 ILCS 5/31.1 (d)(1) (2002),
if Respondents fail
to petition or elect not to petition the lllinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days
of the date of service, the Illinois Pollution
Control
Board shall
adopt
a
final
order,
which shall
include
this Administrative
Citation
and
findings
of violation
as
alleged
herein, and
shall impose the statutory civil penalty specified
above.
When
payment
is
made,
Respondent’s
check
shall
be
made
payable
to

Illinois
Environmental
Protection

mailed
to

Affiant, Garrison Gross, being first duly sworn, voluntarily deposes and states as follows:

Affiant is
a field inspector employed by the Land Pollution Control Division of the
Illinois Enviromriental Protection Agency and has been so employed at all times pertinent hereto.

On March 30? 2005, between 11:55 AM
and 12:25
PM, Affiant conducted an
inspection of a disposal site operated by Richard Holmes, located in Jackson County, Illinois, and
known as Murphysboro/Rich’s Towing by the Illinois Environmental Protection Agency.
Said
site has been assigned site code number 0778015030 by the Agency.

Affiant inspected said Murphysboro/Rich’ s Towing site by an
on-site inspection which
included walking and photographing the site..

A Tire Storage Site and Open Dump
Inspection was conducted
on Wednesday,
March 30, 2005
at Rich’s
Towing in Murphysboro.
Illinois EPA Bureau of Land Inspectors, -Garrison
Gross and Gary Steele,
conducted the inspection.
The property is
located at the intersection of US
51
and Airport Road.
The address is

Airport Road.
The inspection was performed as a follow up to an
earlier
inspection performed on
December
1,
2004.
Weather conditions at the time of the inspection
were overcast skies,

F, and windy.
The inspection began at approximately
11:55
AM.
More than
175 vehicles were observed from offsite
the property.
They were
unsightly and
a scenic
blight
as one
drives
along
US
51
or Airport
Road.
Most ofthem were located in the field south of the auto repair business (photos
001-003).
Two large
piles
of tires
were
observed
from
Airport
Road.
One pile
is
adjacent to
Airport
Road
(photo
004).
This
pile contained approximately
400
tires.
The other pile
is
closer to
the
auto repair shop
(photo
006).
It contained approximately 500
tires.
A few vehicles are visible from Airport road (photo
005).
Due to the absence ofweeds and brush, they appear to be recently acquired vehicles.
We spoke to Rich Holmes, owner ofthe business.
We informed him that the Agency did not receive a
response from him after the last inspection.
Mr. Holmes
said
he didn’t receive the inspection
report.
We informed him
that
the inspection
was sent
certified mail
and
that
someone at the
business
had
singed
for it.
He said
it must have been his
former employee, Matt Shelton.
He said
strange things
had happened while Shelton worked for him.
Mr. Steele said he would hand deliver a copy ofthe.most
recent Violation Notice Letter later in the afternoon.
Mr. Holmes
was questioned about the waste
tires
at the
property~ He
said
he
was
still
working on
getting rid ofthem.
He said the tires belong to Smith Dodge.
He clarified that he brought the vehicles
to
his property to remove the tires and wheels.
The vehicles were taken to Karco
for scrap metal.
He
said
he
is
still
trying to
get
Smith
Dodge
to
pay
for the
disposal
of the
tires.
Mr.
Holmes
said
approximately
100
tires had been hauled off since our last inspection.
He was unable
to
provide the
name, address, telephone number, or tire transporter registration number.
We questioned Mr.
Holmes
about the vehicles at his
property and asked if he
had
a
license
from the
Secretary of State.
He
said
he operates a
towing
business, automotive
repair shop
and
an
impound
yard.
He said
he
didn’t have a license from the Secretary of State but was looking into obtaining one.
We asked him how long it
had been since vehicles
had been removed from the property.
Mr. Holmes
stated that it had been a couple of years
since vehicles had been removed from the property.
We asked
him why so much time had passed.
He said it took anywhere from 60 to
90
days to
obtain a junk title
for the impounded vehicles.
He said he didn’t have the time to
mess with them.
He said his customers
came first, the towing and repair business was second and thejunk vehicles might be third.
Mr. Steele
said
2-3
years
was too
long
a
time
period
to
store
the
vehicles,
plus
it
appeared
that
some of the
vehicles had been there longer than that.

Mr.
Holmes
said
he
didn’t
know there
was
a
problem
with
keeping
vehicles
at
his
property.
We
informed him
that
even
if he
had
a
license
from
the
Secretary
of State,
he
would
need
to
remove
vehicles on a regular basis.
We informed him that without a license,
waste vehicles should be removed
at least once
or twice a
year.
Mr.
Holmes
wanted
to
know why
the Agency
was
getting
tough
on
vehicles.
We
explained the Agency
had been
serious about waste
vehicles
for some
time,
but our
inspections were primarily based on complaints.
We explained that we needed to take some more photographs ofthe vehicles in
the field.
Mr.
Holmes
did not accompany us
on
the remainder of the
inspection.
A
few more piles of tires
were
observed
scattered about the site (photo
009).
Weeds,
small brush and small trees, some 3-4 inches in diameter,
had grown up around the piles oftires (photo
010).
Some ofthe tires were observed offthe rim.
Waste vehicles observed at the site were of various makes, models and
conditions.
Many were 1970’s
thru
1990’s model
vehicles.
Weeds were growing up
around most of the vehicles at the
site.
Several
of the vehicles had been there long
enough for small trees and woody brush to
grow up around them
(photos
007,
008,
015,
016,
&
018).
Some of the trees were
3-4 inches
in
diameter.
Many of the
vehicles
showed
signs of collision
damage
and
several
were
missing
doors, hoods,
andior windows
(photos
011, 012,
& 014).
Other vehicles had the doors open and the interiors exposed to
the elements
(photo
013).
More than
175 waste vehicles were
observed at the site.
Six
waste mobile
homes
were also
observed
at the
site.
A mobile
home observed west of the repair
shop was unleveled
and
had the door open exposing
the interior to
the elements.
Two mobile homes
were
observed directly south of the repair shop.
Both were
overgrown in
small trees and brush (photo
007
&
008).
Three
dilapidated
mobile
homes
were
observed
in
the
field
south of the
repair
shop
(photos 016 & 017).
They were unleveled and missing portions ofthe exterior siding.
The total
amount of waste observed
at the
site,
including the
tires, waste
vehicles
and
mobile homes
was
approximately
3300
cubic
yards.
The
inspection
ended
at
approximately
12:25
PM.
At
approximately
4:00
PM,
Mr.
Steele
returned to
Rich’s
Towing.
He hand
delivered
a
copy
of the
January
5,
2005
Violation Notice Letter and the December
1, 2004 Inspection Report to Mr. Holmes.
The Supervisor of Assessment’s
Office in Jackson
County
identified Linda Holmes
as
the owner of
parcel
15-04-301-003 (15.73 acres)
and
15-04-301-005
(5.64
acres).
They identified Richard Holmes
as the owner of parcel
15-04-301-007 (.89 acres).
Most ofviolations
were observed
