HEARING OFFICER ORDER
  
On June 29, 2005, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that they are discussing minor language in the
stipulation and proposal for settlement (stipulation). The parties represented that discussions
continue. Respondent is given to September 14, 2005, to replead its affirmative defense to
laches
, if needed, and the complainant is given to September 29, 2005, to answer respondent’s
affirmative defense number 2 not addressed in the Board order of March 4, 2004, if needed.
 
The parties are directed to participate in a telephonic status conference with the hearing
officer on August 25, 2005, at 9:15 a.m. The status conference must be initiated by the
complainant, but each party is nonetheless responsible for their own appearance. At the status
conference, the parties must be prepared to discuss the status of the above-captioned matter and
their readiness for hearing. If, however, a stipulation is filed prior to the next status conference,
the conference will be cancelled without further order.
