    HEARING REPORT
     
    On September 15, 2004, a hearing in this matter was held at the County Courthouse in
    Jonesboro, Union County. Attorney Michelle Ryan appeared on behalf of complainant. Ms.
    Ryan filed her appearance with the hearing officer at hearing. Respondent did not appear.
     
    Witness Credibility
     
    One witness testified during the hearing:
     
    Ms. Sheila Williams
     
      
    Based upon my legal judgment, experience, and observations at hearing, I find that the
    credibility of witness is not an issue in this matter.
     
    Exhibits
     
    The complainant offered the open dump inspection checklist dated January 13, 2004 as
    Exhibit 1. The exhibit was admitted into the record.
     
    Briefing Schedule
     
     
    Complainant’s post-hearing brief is due October 6, 2004. It is very unlikely that
    respondent will file a post hearing brief, but the hearing officer set a deadline of October 20,
    2004, so that the Board may close the record. The mailbox rule will apply. The complete
    transcript is due September 27, 2004.
