HEARING OFFICER ORDER

On May 4, 2004, the petitioner informed the hearing officer that it would not be able to

appear at the May 13, 2004, telephonic status conference due to a conflict. To that end, the

May 13, 2004, status conference is cancelled and is rescheduled as noted below. The petitioner

also informed the hearing officer that it has submitted a site classification to the respondent for

review. Finally, the petitioner represented that it will file a waiver of the statutory decision

deadline to and including October 7, 2004.

The parties are directed to participate in a telephonic status conference on

July 8, 2004, at 11:45 a.m. The status conference must be initiated by the petitioner, but each

party is nonetheless responsible for its own appearance. At the status conference, the parties

must be prepared to discuss the status of the above-captioned matter and their readiness for

hearing.
