Complainant,
County
of Jackson,
respectfully
moves this Board
for
an
Order,
in
accordancewith Rule 101.406, consolidating thetwo above captioned administrative citation matters.
In support ofthis request, the Complainant states as follows:
1. There ispending before this Boardtwoadministrative citation matters, docketedas AC 04-
63
and AC 04-64, and both involving the same parties.
2. Both matters aretentatively scheduledfor hearing on November 1, 2004 in Jackson County
before Hearing Officer Carol Sudman.
3.
Consolidation ofthese two cases is expeditious, in the interest ofconvenience, and will
result in a complete determination ofall claims.
Consolidation will not cause either party material
prejudice.
4. Consolidation was discussed with
the Hearing Officer and the Respondent’s attorney,
Gregory Veach, on August 24, 2004.
There was no objection to consolidation.
WHEREFORE, the Complainant respectfully requests these matters be consolidated.
