HEARING OFFICER ORDER
The Illinois Environmental Protection Agency (Agency)
filed a proposal with
the Board
on April
7, 2003,
to amend the Board’s permitting rules for public water supplies (PWS) at 35 Ill.
Adm. Code 602.
The Agency asks the Board to
adopt the proposed amendments before
December
8, 2003, when existing regulatory exemptions from restricted status expire and
the
final radionuclide standard for drinking water takes effect.
Today the Board accepted the
proposal
for hearing.
The proposal would allow the Agency to continue issuing permits to PWS that exceed the
drinking water Maximum Contaminant Level (MCL) for combined
radium, gross alpha particle
activity,
or uranium, but only if the PWS is
bound by court order or Compliance Commitment
Agreement to meet the standard.
The proposal also seeks to
require new certifications for
construction permit applications and to update references to Agency technical and design criteria.
Two hearings are presently scheduled forR03-21, as noted above.
The purpose ofthese
hearings is to
allow the Board to
receive testimony from the Agency and other interested persons
on the merits and
economic impact ofthe proposal.
At hearing, all persons who testify will be
sworn and
subject to questioning.
The Board also will receive testimony on any economic impact
study (EcIS) conducted by the Department ofCommerce and Community Affairs (DCCA) on the
proposed rules orDCCA decision not to perform an EcIS.
The Agency’s rulemaking proposal, including its statement ofreasons and proposed
amendatorylanguage, maybe obtained on the Board’s Web Site through the Clerk’s Office On-
Line (COOL) at www.ipcb.state.il.us.
Public comments, hearing transcripts, and opinions and
orders in R03-21
also will be available on-line through COOL.
The Notice List forthis rulemaking is the list ofpersons who wish to receive only the
Board’s opinions and orders and hearing officer orders.
The Service List is the list ofpersons
who wish to activelyparticipate in this proceeding and receive not only opinions and
orders, but
also other filings such as public comments.
