This matter comes before the Board on a petition filed on
April 24,
1992.
On June
3,
1993,
the Board directed the
parties to file a status report concerning this matter on or before
July
6,
1993.
On July 14,
1993, the parties filed
a joint status report
and a motion
for leave to file
instanter.
The motion to file instanter is hereby granted.
The
parties
state
that
they
are
engaged
in
very
serious
negotiations which may lead to the resolution of this matter.
The
parties report that as a result of the negotiations, petitioner has
agreed to perform stack testing of several emission units.
They
state it will be at least six weeks before petitioner will receive
the stack testing results.
The parties state that they will need
additional
time
for evaluation
after
the results
come
in.
The
parties have proposed to submit a status report to the Board after
review of the test results or on September 15,
1993, whichever
is
earlier.
The parties
are directed to file
a status
report with the
Board concerning this matter on or before September 15,
1993.
