Environmental
Protection Agency by Section 31.1
of the Illinois Environmental Protection Act, 415
ILCS 5/31.1

FACTS
1.
That C. John Blickhan
(“Respondent’) is the present operator of a facility located at
Lock
and
Dam
Road,
Quincy, Adams
County,
Illinois.
The
property
is
commonly known
to the
Illinois
Environmental Protection Agency as Quincy/Blickhan
Landfill.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating
Permit and
is designated
with
Site Code No. 0010650002.
3.
That Respondent has owned and operated said facility at all times pertinent hereto.
4.
That on June 24, 2004,
Michelle
E. Cozadd of the Illinois Environmental Protection
Agency’s
Springfield
Regional
Office
inspected
the
above-described
facility.
A
copy
of
her
inspection
report setting
forth the
results of said
inspection
is attached
hereto
and
made
a
part
hereof.
VIOLATIONS
Based upon direct observations made by Michelle
E.
Cozadd during the course of her June
24, 2004 inspection of the above-named facility, the Illinois Environmental Protection Agency has
determined that
Respondent has violated the Illinois Environmental Protection Act (hereinafter, the
“Act”) as follows:
(1)
That
Respondent
caused
or allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
litter,
a
violation
of
Section
21(p)(1)
of
the Act, 415
ILCS 5/2l(p)(1)
(2002).
(2)
That
Respondent
caused
or
allowed
the
open
dumping
of w~stein
a
manner
resulting
in
deposition
of
general
construction
or
demolition
debris
or
clean
construction ordemoRtion debris, a violation of Section 21 (p)(7) of the Act,415 ILCS
5/21 (p)(7) (2002).
CIVIL PENALTY
Pursuant to
Section
42(b)(4-5) of the
Act,
415
ILCS
5/42(b)(4-5)
(2002),
Respondent is
subject
to
a
civil
penalty
of
One Thousand
Five
Hundred
Dollars
($1,500.00)
for
each
of
the
violations identified above, for a totalof Three Thousand
Dollars ($3,000.00).
IfRespondent elects
notto petition the Illinois Pollution Control Board, the statutory civil penaltyspecified above shall
be
due and
payable no later than Auç~ust
31, 2004,
unless otherwise provided by order of the Illinois
Pollution Control
Board.
If Respondent elects to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31.1
of the Act, 415 ILCS 5/31.1(2002), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatoryhearing,
Respondent shall be assessed the associated
hearing costs incurred by the Illinois Environmental

Protection Agency and the Illinois
Pollution Control Board.
Those hearing costs shall be assessed
in addition
to
the
One Thousand
Five
Hundred
Dollar ($1,500.00) statutory civil penalty for each
violation:
Pursuant to Section 31.1 (d)(1) ofthe Act, 415 ILCS 5/31.1 (d)(1) (2002), if Respondent fails

Affiant, Michelle E. Cozadd, being first duly sworn, voluntarily deposes and states as
follows:

Affiant is a field inspector employed by the Division ofLand Pollution Control/Field
Operations Section ofthe Illinois Environmental Protection Agency and has been so
employed at all times pertinent hereto.
2.
On June 24, 2004 between 2:20 PM and
2:55
PM, Affiant conducted an inspection of
a disposal
site operated without an Illinois Environmental Protection Agency permit,
located in Adams County, Illinois, and known as Blickhan by the Illinois
Environmental
Protection Agency.
Said site has been assigned
site code number LPC #0010650002 by
the Illinois Environmental Protection Agency.
3.
Affiant inspected said Blickhan open dump site by an on-site inspection that included
walking and photographing the site.
4.
As
a result ofthe activities referred to in paragraph
3
above, Affiant completed the
Inspection Report form attached hereto and made a part hereof, which,
to the best of
Affiant’s knowledge and belief, is
an accurate representation ofAffiant’s observations
and
factual conclusions with respect to said Blickhan open dump.

A
landfill inspection was conducted at
this facility on June 24, 2004.
The applicable permit at
the time ofthe inspection was Supplemental Permit No. 2003-450-SP (“Permit”).
The inspection
took place from approximately 2:20 pm to 2:55 pm, and thirteen digital photographs were taken,
Weather at the time ofthe inspection was sunny and about 80°F.Upon arrival at the site, I
explained to the gentleman in the office that I wanted to conduct a routine inspection of the
landfill to
which he gave his approval.
I requested copies ofthe last four quarterly landfill
inspection reports.
He explained that Ms. Dawn Livingston was not in the bffice today but
would have her fax me the reports when she returned.
The permitted landfill consists oftwo areas.
The property that includes Site No.
1
and Site No..
2, and the surrounding area is owned by John Blickhan.
The landfill was certified closed on
August 21, 2000,
and is currently in post-closure.
Site No. 2
located in the northeast corner of
the referenced facility was inspected first.
Adequate vegetative cover was observed in
this 3-acre
area as shown in the attached photo
#1.
The site was adequately mowed and no
woody
vegetation was 0observed.
Site No.
I located on the western portion of the facility is shown in the attached photo #2.
The
vegetative cover at Site No.
1
appeared in
good condition.
A
small portion of the side
slope in
the northwest corner was not mowed.
This
area must also be mowed to maintain the integrity of
the cover on this side slope.
The six groundwater monitoring wells were inspected.
All six
wells had locked protective steel
covers and
legible labels.
Additional well information can be
found on the attached Monitor
Well Inspection Form.
While conducting my inspection of Site No.
1, I observed that the soil along the tree line on the
south
side of Site No. I has been reworked.
The attached photo #3
shows a small pile ofgeneral
construction or demolition debris that appeared to have dumped then pushed into the tree line.
The pile contained broken concrete, scrap metal and damaged
dimensional lumber.
I followed
the tree line
to the east where I observed a second area where the soil has been pushed into the
tree line.
Two large paper rolls
were observed in the area as shown in the attached photo #4.
As
I continued
following the tree line as it curved around back to the west, a large pile of
l~ndscapewaste and waste materials was observed pushed into the tree line.

located east ofthe
larger pile.
This pile contained charred damaged dimensional lumber, scrap
metal and
landscape waste.

This pile contained charred tree trunks, concrete blocks,
scrap metal, wood pallets,
plywood, insulation, pieces of black plastic,
landscaping payers, railroad ties, glass bottles, a
wood
door, aluminum window blinds,
broken pieces ofdrywall, styrofoam, and
miscellaneous
debris.
As shown
in the photos,
a portion of this waste has been burned.
The western portion of
the pile contained the majority of the tree trunks
whereas the waste materials~appearedto have
been open dumped on the east side of the pile.
The overgrowth of the vegetation prevented
a
thorough inspection of the area.
The soil in front ofthe pile appears to have been
reworked with
construction debris
poking out of the surface level that suggests that waste
materials may have
been possibly buried.
I could not tell if the waste
was burned on site.
The attached photo
#9 shows a line of concrete blocks east of the large debris pile.
Ms. Dawn Livingston faxed the quarterly landfill inspection reports to me on June 28,
2004.
The
attached reports were dated October
10, 2003, January 6, 2004 and April 2, 2004.
No apparent violations were noted in the permitted portions of the site (see attached landfill
checklist).
