    ORDER OF THE BOARD

    This matter is before the Board on a February 25,
    1994
    motion to file the record instanter,
    filed by the Illinois
    Environmental Protection Agency
    (Agency).
    The petition was
    filed with the Board on February
    2,
    1994.
    Pursuant to 35 Iii.
    Adm. Code 105.102(a) (4), the Agency record is to be filed with
    the Pollution Control Board within 14 days “upon notice of the
    petition”.
    The Agency believes that the petitioner will not be
    prejudiced by the filing of the Agency record at this time.
    The
    motion to file the record instanter
    is granted.
    The filing requirements of
    35 Ill. Adm. Code 101.103 require
    that an original plus nine
    (9)
    copies of documents be filed with
    the Board.
    The Agency filed an original plus three
    (3)
    copies of
    the record with the Board but did not file a motion requesting an
    exception to the filing requirement.
    The Board on its own motion
    will waive the filing requirement and accept the record as filed.
