HEARING OFFICER ORDER
On August 19, 2004, all parties participated in a telephonic status conference with the
hearing officer. The respondent again represented that it is still reviewing petitioner’s proposal
letter and anticipates a response in the near future. If the proposal is accepted, the petitioner
represented it will file a motion to voluntarily dismiss this appeal.
The parties are directed to participate in a telephonic status conference with the hearing
officer on October 21, 2004, at 10:00 a.m. The telephone status conference will be initiated by
the petitioner, but each party is nonetheless responsible for its appearance. At the telephone
status conference, the parties must be prepared to discuss the status of the above-captioned
matter and their readiness for hearing. If, however, petitioner files a motion to dismiss is filed
prior to the next status conference, the status conference will be cancelled without further order.
