    PROPOSAL FOR PUBLIC COMMENT.
    REASON FOR DELAY.
    ORDER OF THE BOARD

    Section 13.3 of the Environmental Protection Act
    (Act)
    (415
    ILCS 5/13.3
    (1992))
    requires the Board to adopt regulations which
    are “identical in substance” with U.S. EPA wastewater
    pretreatment rules adopted pursuant to Sections 307(b),
    307(c),
    307(d),
    402(b) (8),
    and 402(b) (9)
    of the Federal Water Pollution
    Control Act (Clean Water Act),
    as amended.
    The term “identical
    in substance” has recently been defined in Section 7.2 of the
    Act.
    Section 7.2(b)
    of the Act requires the Board to adopt a
    rule within one year of adoption of federal rule, unless the
    Board extends the time based on
    a finding that the time is
    insufficient and stating the reasons.
    It appears that the
    regulations in this Docket will be late.
    The Board
    is therefore
    entering this order to extend the time.
    The Board hereby finds that an extension of time
    is
    necessary.
    The presently—anticipated completion date for this
    proceeding is June 16,
    1995.
    The reason for delay in adopting
    these regulations is staff turnover which required the
    reassignment of this matter to a new Board Member for
    coordination.
    The Board today adopts a proposal for public comment in a
    separate opinion and order.
    Pursuant to Section 7.2(b)
    of the
    Act, the Board will submit a copy of the text of this order for
    publication in the Illinois Register as expeditiously as
    possible.
    IT IS SO ORDERED.
