This matter is before the Board pursuant to a Motion to Lift
the
Stay
and Schedule
Proceeding
filed
by
the General
Motors
Corporation (“GM”) on January 28, 1994.
On June 23, 1993, GM filed
a petition seeking site specific relief regarding the
fluoride
water
quality standard in the receiving waters
at its
facility
located in Danville, Illinois.
By hearing officer order, the Board
set
this matter
for
hearing
on December
7,
1993
in
Danville.
Pursuant to an uncontested motion to cancel hearing, on November
18,
1993,
the Board
stayed
this matter
for
sixty
days so
the
parties
could
determine
whether
additional
relief
would
be
necessary.
According to
the
motion
to
lift
the
stay,
“after
additional review of the data and discussions with the Agency,
it
has become clear that further relief is not necessary”; GM wishes
to go forward with the hearing at this time.
We hereby grant GM’S Motion to Lift the Stay and Schedule
Hearing.
The hearing schedule shall be the subject of
a future
hearing officer order.
