    HEARING REPORT
     
    On July 18, 2005, a hearing in this matter was held at City Hall in Salem, Marion County.
    Attorney Michelle Ryan appeared on behalf of the complainant. Ms. Ryan filed copies of her
    appearance at hearing. Respondent appeared
    pro se
    .
     
    Witness Credibility
     
     
    2 witnesses testified during the hearing:
     
    Mr. Chris Cahnovsky
    Mr. John Groff
     
      
      
    Based upon my legal judgment, experience, and observations at hearing, I find that the
    credibility of witness is not an issue in this matter.
     
    Exhibits
     
    The complainant offered two exhibits as evidence at hearing. Exhibit 1 is the open dump
    inspection checklist dated July 29, 2004. Exhibit 2 is the open dump administrative citation
    warning notice. Respondent did not object to the admission of either exhibit. Both exhibits were
    admitted into the record.
     
    Briefing Schedule
     
    The transcript is due by July 28, 2005. Complainant will file its brief by
    August 11, 2005. Respondent’s brief is due by August 26, 2005. Complainant’s reply, if any, is
    due by September 2, 2005. The mailbox rule will apply.
