    HEARING OFFICER ORDER
     
    On June 16, 2005, the parties were scheduled to participate in a telephone status
    conference with the hearing officer. Neither party appeared, although petitioner left a message
    for the hearing officer stating that it was waiting to hear whether respondent received the final
    documentation for the settlement agreement. As it appears that this case is ready to be
    dismissed, the parties are encouraged to contact each other so that petitioner may file a motion to
    voluntarily dismiss before the next status conference.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 10:30 a.m. on August 16, 2005. The status conference shall be initiated by the
    petitioner.
     
    Petitioner has filed an open waiver of the statutory decision deadline for this case.
