ORDER OF THE BOARD (by G.T. Girard):
Section 9.1(e) of the Environmental Protection Act (Act) requires the Board to adopt
regulations which are "identical in substance" to exemptions from the definition of "volatile
organic material" (VOM) those compounds that USEPA has found to be exempted from
regulation under state implementation plans for ozone due to negligible photochemical
reactivity. USEPA has codified these exemptions as part of its definition at 40 CFR
51.100(s). Accordingly, the Board reserved this docket for USEPA amendments during the
period from January 1 through June 30, 1996.
During the period from January 1 through June 30, 1996, USEPA amended its
definition of VOM on February 7, 1996, at 61 Fed. Reg. 4588, to add perchloroethylene
(tetrachloroethylene) to the list of chemical species that are exempted from the definition of
VOM and, hence, are exempted from regulation for control of ozone precursors. As a result
of receipt of a public comment, the Board reserved docket R96-16 to deal with the subject
matter of the February 7, 1996 federal amendment. USEPA made no further amendments to
its definition of VOM during the time-frame of the present docket.
For the foregoing reasons, the Board hereby dismisses this proceeding.
