    Proposed Rule.
    Dismissal Order.
ORDER OF THE BOARD (by M. McFawn):
Section 22.4(d) of the Environmental Protection Act (Act) requires the Board to adopt
regulations which are "identical in substance," as defined in Section 7.2 of the Act, to
underground storage tank (UST) regulations promulgated by the U.S. Environmental
Protection Agency (USEPA) pursuant to Section 9003 of RCRA to implement Subtitle I of
RCRA, with certain limitations. USEPA has codified its UST regulations at 40 CFR 281
through 283. Accordingly, the Board reserved this docket for any UST amendments adopted
by USEPA between July 1 through December 31, 1996. However, the only USEPA
amendments to its UST regulations during that time period related to the approval of three
sister states' UST programs, none of which will require corresponding Board action.
For the foregoing reason, no change is necessary at this time, and the Board hereby
    dismisses this proceeding.
    IT IS SO ORDERED.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, do hereby certify
that the above order was adopted on the 1
    st

day of May, 1997, by a vote of 7-0.
    Dorothy M. Gunn, Clerk
    Illinois Pollution Control Board
