OPINION OF THE BOARD
(by Mr. Kissel):
On February
21,
1972, Central
Illinois Public Service Company
(CIPC0)
submitted a Petition
for Clarification to the Board.
This
Petition sought clarification of Paragraph
2 of the Board Order
which reads as follows:
“2.
(PCB 71—262)
From Units #1 and
#2, at the Hutson-
ville Station, until January
1,
1974, provided that:
a.
Units
#1 and
#2 shall be on
“hot standby”
as defined in the Board’s opinion only
until September
30,
1972; and
b.
After September
30.,
1972, Units
#1 and #2
shall be placed on “cold standby” as de-
fined in the opinion,
only until January
1,
1974.”
CIPC0 indicates that it
is presently evaluating
the feasibility of
converting Hutsonville #1 and
#2 boilers to oil.
The use
of oil
as
a fuel source would apparently bring the plant into compliance
with the Illinois
air pollution regulations.
CIPC0 then questions
whether Section 2(b)
of the Order
acts as
a limiting factor upon
CIPC0’s operations by insisting that the plant remain on “cold
standby” until January
1,
1974.
The Board Order is not intended
to mandate that
the plant remain on “cold standby”, but only to
insure that
if tue boilers are
to be operated in violation of the
applicable regulations after September
30, 1972,
that they then
be operated only on
a “cold standby” basis.
If CIPC0’s change of
fuel results
in the Hutsonville #1 and #2 boilers coming into
compliance,
there exists no need at all for
a variance.
