Opinion of the Board
(by Mr. Currie):
In August,
1970,
the Agency filed with this Board a complaint
charging Alton Box with operating an open-top destructor in viola-
tion of the terms of a permit issued by the former Air Pollution
Control Board and in violation of Section 9(b)
of the Environmental
Protection Act.
A hearing was scheduled on the complaint.
However, the Agency subsequently filed a written motion to
dismiss the case, concurred in by the company.
The Agency orally
explained, at the Board’s public meeting on September 16 that it was
confessing error and had not the evidence to prove its allegations.
On the basis of this statement, the Board hereby dismisses the
complaint.
