ORDER
Calumet Steel, Division of Borg Warner Corporation,
(Calu-
met
has filed a Petition for Variance with the Board seeking an
extension of an existing Air Contaminant Emission Reduction Pro-
grain
(ACER?) to and including August 31, 1971, to install a
canopy—type evacuation system on electric furnaces used
in its
operation.
Calumet~sACER?, based on precedent established by
the Board
in other cases, expired on July
1,
1971, and this petition
for an extension to August 31, 1971 was filed with the Board on
June 30, 1971.
Before the Board would have a chance to hold a
hearing on this matter,
the August 31,
1971 date will have been
reached; therefore, a hearing will not be authorized by the Board
at this time,
However,
it is important that the Board know that
the control devices detailed in
the ACERP and
in the Petition for
variance filed by Calumet have been installed,
To insure that
the Board receives the necessary information from
Calume’c,
the
following order is hereby entered:
1.
Calumet
is hereby ordered to file a written report
with the Board and with the Environmental Protection
Agency on September
3,
1971,
indicating the status
of the completion of the control devices detailed
in the ACERP, hereinbefore granted by the prior Air
Pollution Control Board, and the Petition for Variance
filed by Calumet on June 30,
1971.
2.
This action and order by the Board shall not be
considered to be
a grant or denial of the Petition
for Variance filed by Calumet on June 30,
1971.
