ILLINOIS POLLUTION CONTROL BOARD
February
22, 1972
TENNIS DEVELOPMENT,
INC.
v.
)
PCB
72-59
ENVIRONMENTAL PROTECTION AGENCY
OPINION OF THE BOARD
(by Mr.
Richard J. Kissel):
Tennis Development,
Inc.
requests
a variance from Paragraph
Seven of the Board Order of March
31,
1971 in
the
case of League
of Women Voters
v,
North Shore Sanitary District, PCB
70-7,
12,
13
and 14.
Tennis Development seeks
to construct
an indoor tennis
building on Lot 12
in the North Shore Industrial and Research Centre,
Lake Bluff.
The variance petition is uninformative
as to the type of
facilities
to be installed within the building and as to the persons
who will be using such facilities.
This
case may well
fall within
the ambit of the precedent established in Waukegan Park District
v.
Environmental Protection Agency,
PCB
71—314, 71-342 wherein the
Board held
that since the persons using the facilities would be
the same persons
as are living in the District the sewage load
would be substantially unaffected by allowing the additional con-
nections.
In the interest of expedition, we will not dismiss this
case
but will hold it for disposition
upon
the filing of
the supple-
mental information requested herein.
Such information shall
be
submitted to
the
Board within twenty
(20)
days
of the entry of this
order.
I, Christan
L. Moffett,
Clerk of the Pollution Control Board,~
certify that
the Board adopted the above Opinion and Order
