The motions to dismiss by
the respondents
in
##71—358 and 71-368, and by Saline Branch Drainage District
in #71-365,
are hereby denied.
We do not believe the complaints
in the first two cases could be more specific without requiring
the Agency
to plead all its evidence, and the respondents
are
amply apprised of the charges against them.
The constitutional
argurr~ents advanced in #71-368
are without merit under numerous
Board precedents.
The defense raised by the Drainage District
in #71-365 is
a factual
one as to which proo.f may be made at the
hearing.
The request for oral argument on
the motion in #71-358
is
denied.
