Geneva sought a variance to engage in open burning for

firefighting instruction purposes.

We have since received

a stipulation indicating that there is no need for a variance,

as the Agency has issued a permit to allow the burning

pursuant to our regulations.

The petition for variance is

therefore dismissed.
