Opinion and Order of the Board
(by Mr.
Currie):
Hoffman on July
16,
1971 petitioned for
a variance to permit
continued operation of
a portable asphalt plant without control
equipment for sixty days beyond termination of
a then existent
strike against the company.
The Agency opposed the petition.
On
September
1 Hoffman filed
a reply to the Agency’s recommendation,
reciting that the strike ended August
6 and that the control equip-
ment was installed immediately thereafter.
The company consequently
moves
to withdraw its petition without prejudice.
We grant the
motion,
as the installation of the equipment leaves
the company
seeking nothing
from this Board at this
time.
The opportunity
will remain for either party
to seek any relief that may seem
appropriate in the
future,
through the filing of
a complaint,
petition
for variance, or otherwise.
The petition for variance is dismissed.
