FACTS
1.
That
Bill
Collins
(“Respondent”) is the
present operator of a facility located at the
southwest corner of an agricultural field west of Mainline Road, West Frankfort,
Franklin
County,
Illinois.
The property is commonly known
to the
Illinois
Environmental Protection Agency as West
Frankfort/Collins,
Bill #2.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating
Permit and
is designated with
Site Code No. 0558045009.
3.
That Respondent has
operated said facility at all times pertinent hereto.
4.
That on June 9,2004, KentJohnson of the Illinois Environmental Protection Agency’s
Marion
Regional
Office
inspected
the
above-described facility.
A
copy of
his
inspection
report
setting forth the results of said
inspection is attached hereto and made a part hereof.

VIOLATIONS
Based
upon
direct
observations made
by Kent Johnson
during
the course
of his June
9,
2004
inspection
of
the
above-named
facility,
the
Illinois
Environmental
Protection
Agency
has
determined that Respondent has violated the Illinois Environmental Protection Act (hereinafter, the
“Act”) as follows:
(1)
That
Respondent
caused
or
allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
litter,
a violation
of
Section
21(p)(1)
of the
Act, 415
ILCS 5/21(p)(1)
(2002).
CIVIL PENALTY
Pursuant
to
Section
42(b)(4-5)
of
the Act, 415
ILCS
5!42(b)(4-5)
(2002),
Respondent is
subject
to
a
civil
penalty
of
One
Thousand
Five
Hundred
Dollars
($1,500.00)
for each
of
the
violations
identified
above,
for a
total
of
One
Thousand
Five
Hundred
Dollars
($1 ,500.00).
If
Respondent elects
not
to
petition
the Illinois
Pollution
Control
Board,
the
statutory civil
penalty
specified above shall be due and payable
no
later than August 16, 2002, unless otherwise provided
by order of the Illinois Pollution
Control Board.
If Respondent elects to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board
in accordance with Section
31.1
of the Act, 415 ILCS 5/31 .1(2002), and if the Illinois
Pollution Control Board issuesafinding of violation as alleged herein, after an adjudicatoryhearing,
Respondent shall be assessed the associated hearing costs incurred by the Illinois Environmental

Complaint Investigation Report Narrative
This unpermitted site was inspected on June 9, 2004 by this author and Robert Mileur
representing the Agency.
The inspection was conducted in response to a complaint alleging the
open dumping ofsolid waste including roofing shingles and used/waste tires.
The inspection
was conducted from approximately
1:35
to 2:03
P.M., and six photos were taken during that
time.
Weather at the time ofthe inspection was partly cloudy and warm with dry soil and a
slight breeze.
Mr. Bob Brock, equipment operator, and Mr. Bill Coiiins, property owner, were
interviewed during this inspection.
No samples were taken during this inspection.
General Remarks/Inspection Findings
This site is located at the southwest corner ofan agricultural field west ofMainline Road,
West
Frankfort.
Mainline Road runs west from Industrial Park Road/Ken Gray Boulevard, which are
situated on the west side of West Frankfort, north of Route 149.
According to information
provided by Mr. Collins, he has owned this site for approximately seven years.

The equipment operator interviewed
during this inspection is Bob Brock,
General Delivery, Logan, IL 62856; Mr. Brock’s phone
number is 618/435-3324.
According to Mr.
Brock, he was hired by Mr. Collins
to clear a rOad
south through the property along an old railroad right-of-way.
In exchange for this serviée, Mr.
Collins allowed him to cut and sell trees from the impactedarea.
Upon our arrival in the area, Inspector Mileur and I saw a bulldozer from Mainline Road, and
proceeded along a dirt field road to that area.
Once there, I introduced myselfto a man who
identified himself as Bob Brock.
I explained to Mr. Brock why Iwas there, and asked him if
there was waste dumped and/or buried on the property.
Mr. Brock said that there were
some
shingles
in the way where he was clearing, so he had pushed them to the side.
He was adamant
that he did not bury anything, nor had he been told to bury anything by Mr. Collins, the property
owner.
I asked Mr. Brock when he was hired to clear the area, and he said that he had been talking to
Mr. Collins “since last year”.
Mr. Brock said that he had to go home and weld a line for his
bulldozer
(Komatsu model
# D65E), and he got ready to
get into a truck.
Prior to his departure, I
told him that I would like to look at the property.
He offered to walk with me, and escorted me
to an area near the north end where demolition debris and tires were located.
After we looked at

these areas initially, Mr. Brock left the site while Inspector Mileur and I walked the rest ofthe
distance south along the newly developed access.
No other areas were noted.
As we returned to the vehicle, photos were taken ofthree separate
areas.
The largest pile of
demolition debris was located east ofthe access road

from the edge ofthe access road on the west side.
In addition,
8-10 used/waste tires were
observed toward the north end ofthe access road on the west side

After taking photos, we got into the vehicle and began to
leave, meeting Mr. Collins as he drove
into the site.
I explained the situation to Mr. Collins, and he asked what he
needed to do to
resolve the situation.
I informed Mr. Collins that he should remove all ofthe waste to proper
facilities, and that receipts should be kept to document proper disposal.
I explained the general
course of action with regard to
enforcement for open dumping sites,
and Mr. Collins
acknowledged the information.
Before leaving, I reminded Mr. Collins that I would need to go
back to
his other site in the near future (LPC
# 0558040007).
He said that he nearly had it “all
cleaned up”, as he had acquired 20,000 square feet ofinside storage at the old American Fiber-
lite facility near Marion, Illinois (LPC #
1990555038).
I told Mr. Collins that I ~vouldcall him to
schedule an inspection at his other facility.
Summary of Inspection Findings
Based on the fact that waste from off-site, including demolition debris and used/waste tires, have
been open dumped at this site, the following apparent violations are being cited atthis time.
Violations ofSections 21(a), 21QD)(l), 21Q)(7), and
55(a)(l)
are being cited because waste,
including demolition debris and used/waste tires, have been open dumped resulting in litter at
this site.
Violations ofSections 21(d)(l) and 812.101(a) are being cited because from off-site has been
brought to this facility, which does not have a permit to receive waste.
This is apparent due to
the fact that no buildings have apparently existed on this property, and there is no apparent
reason for tires to be generated at this site, which contains neither a residence nor a business.
Violations of Sections 21(d)(2) and 21(e) are being cited because violations of the Illinois
Environmental Protection Act and Board regulations were
observed at the time ofthe inspection.
