FACTS
1.
That Louis
Rutherford (“Respondent”) is a waste hauler, operating within
Sangamon County, Illinois.
2.
That the Respondent is the owner real property that consist of threeparcels of
with four houses located on them.
The property is commonly know as 712, 714,
718, and 726 N.

That said property is an open dump operating without an Illinois Environmental
Protection Agency (“IEPA”) Operating Permit and is designated with IEPA Land Pollution
Control

That Respondent has owned said property at all times pertinent hereto.
5.
That on July 2, 2003, Allen Alexander and Brian Wood ofthe
Sangamon County Department ofPublic Health (“SCDPH”) inspected the above-described
properties.
A copy oftheir inspection report setting forth the results of said inspection is
attached hereto and made a part hereof.
VIOLATIONS
Based upon direct observations made by Allen Alexander and Brian Wood during the
course oftheir July 3, 2003
inspection ofRespondent’s property, the County of Sangamon
has determined that Respondenthas violated the Act as follows:
1.
That Respondent caused or allowed the open dumping ofwaste in a manner
resulting in litter, a violation ofSection 21Q)(1) ofthe Act, 415 ILCS
5/21@)(l)
(2002); and
2.
ThatRespondent caused or allowed the operation of a solid waste management
facility without a permit
in violation ofSection 21(d)(1).
CIVIL PENALTY
Pursuant to
Section
42(b)(4-5)
ofthe Act, 415 ILCS
5/42(b)(4-5)
(2002), Respondent is
subject to
a civil penalty ofOne Thousand Five Hundred Dollars
($1,500.00)
for each ofthe
violations
identified above, for a total ofThree Thousand Dollars ($3,000.00).
IfRespondent
elects not to petition the Illinois Pollution Control Board, the statutory civil penalty specified
above shall be due and payable no later than September
8.

otherwise provided by
order ofthe Illinois Pollution Control Board.

IfRespondent elects to contest this Administrative
Citation by petitioning the Illinois
Pollution Control Board in accordance with Section
31.1 ofthe Act, 415 ILCS
5/3 1.1
(2002), and
if the Illinois Pollution Control Board issues a finding ofviolation as alleged herein, after an
adjudicatory hearing, Respondent shall be assessed the associated hearing costs incurredby the
County ofSangamon and the Illinois Pollution Control Board.
Those hearing costs shall be
assessed in addition to the One Thousand Five Hundred Dollar ($1,500.00) statutory civil penalty
for each violation.
Pursuant to
Section 31.1(d)(1) ofthe Act, 415 ILCS
5/31.1(d)(1) (2002), if Respondent
fails to petition or elects not to petition the Illinois Pollution Control Board for review ofthis
Administrative Citation within thirty-five

days ofthe date of service, the Illinois Pollution
Control Board
shall adopt a final order, which shall include this Administrative Citation and
findings ofviolation as alleged herein, and shall impose the statutory civil penalty specified
above.
When payment is made, Respondent’s check shall be made payable to the Sangamon
County Department ofPublic Health and mailed to
the attention ofJames D.
Stone, Director of
the Sangamon County Department of Public Health, 2501 North Dirksen Parkway, Springfield,
Illinois 62702.
Along with payment, Respondent shall complete and return the enclosed
Remittance Form
to
ensure proper documentation of payment.
Ifany civil penalty and/or hearing costs are not paidwithinthetime prescribed by order of the
Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
against Respondent from the date payment is due up to
and including the date that payment is

The State’s Attorney ofSangamon County maybe requested to initiate proceedings
against Respondent in Circuit Court to collect said penalty and/or hearing costs,

the State’s Attorney ofSangamon County will seek to recover his costs oflitigation.
