OPINION AND ORDER OF THE BOARD

The City of Freeport has petitioned for a variance from Rule
5.07(b)
of the Rules and Regulations for Refuse Disposal Sites
and
Facilities,
in order to be allowed until June 1,
1973 to apply final
cover to the surface area of
a previously used landfill site.
The
petition indicates that if the cover program
is spread over the period
of time sought,
it will result in a far less cost to the City than if
such cover was purchased and applied at one time.
The City also states
that the present winter weather conditions may impede the program if
immediate cover is required.
The Agency recommends that the variance be allowed, but only
until May 1,
1973.
We see no reason to deny the City the extra month
that it seeks
in this respect and accordingly, grant the petition as
requested.
IT IS THE ORDER of the Pollution Control Board:
1.
City of Freeport be granted a variance from the provisions
of Rule 5.07(b) of the Rules and Regulations for Refuse
Disposal Sites and Facilities until June
1,
1973,
at which
time the former landfill site known as Freeport Municipal
#1 shall be in compliance with all relevant statutory
provisions and regulations with respect to the conduct of
landfill sites.
