    1 MR. KNITTLE: Good morning. My name
    2 is John Knittle. I am the hearing officer
    3 for this rulemaking proceeding R05-11. Today
    4 is February 22nd, 2005. It is about 10:30
    5 a.m. We are at the James R. Thompson Center,
    6 100 West Randolph Street.
    7 Present with me today from the board
    8 is Board Member Tom Johnson, Board Member
    9 Tanner Girard, Anand Rao and Alisa Liu from
    10 our technical staff.
    11 This is, as I said, R05-11 in the
    12 matter of amendments to 35 Illinois
    13 Administrative Code 205, Emissions Reduction
    14 Market System, and 35 Illinois Administrative
    15 Code 211.
    16 First, I want to introduce Board
    17 Member Johnson. He is the board member who
    18 is shepherding this rulemaking process.
    19 Do you have any comments you would
    20 like to make at this point?
    21 MR. JOHNSON: No.
    22 MR. KNITTLE: Okay. I am not going
    23 to go over the procedural background or any
    24 of that information. We did that at the last

    1 hearing, at which there were no members of
    2 the public present. I want to note for the
    3 record that there are no members of the
    4 public present here. If they were here,
    5 they, of course, would be able to testify
    6 and/or ask questions of the Agency as

    7 proponents.
    8 I also want to note that if there
    9 were somebody here, we would ask them if they
    10 wanted to sign up for the notice or service
    11 list and sign up and do all that. But, of
    12 course, there is nobody here.
    13 So at this point, I am going to turn
    14 it over to the petitioner, the Agency, and
    15 ask Mr. Matoesian to introduce himself and
    16 his witness.
    17 MR. MATOESIAN: Good day, Gentlemen.
    18 My name is Charles Matoesian. I am an
    19 attorney for the Illinois Environmental
    20 Protection Agency. At this point we have no
    21 further comments concerning the ERMS
    22 rulemaking. And we will stand on the record
    23 at this point. That is all.
    24 MR. KNITTLE: Okay. Thank you, sir.

    1 There are no other parties here. I want to
    2 ask board members if they have any questions
    3 or comments they want to make at this point
    4 in time.
    5 MR. GIRARD: Not at this time,
    6 thanks.
    7 MR. KNITTLE: That is the indication
    8 of no. Mr. Rao, Ms. Liu?
    9 MS. LIU: Did the Agency introduce
    10 their witness?
    11 MR. KNITTLE: No, they did not.
    12 That is a fine point.
    13 MR. MATOESIAN: Mr. David Bloomberg
    14 is with me today.
    15 MR. KNITTLE: And ready and willing
    16 to answer questions if, in fact, there were
    17 any questions.
    18 Other than that, Ms. Liu?
    19 MS. LIU: No, thank you.
    20 MR. KNITTLE: I have no questions.
    21 Let's go off the record. We are going to
    22 hold this open for 15 minutes to make sure if
    23 members of the public want to attend, they
    24 have that opportunity. Let's go off the

    3 MR. KNITTLE: We are back on the
    4 record. It is 10:46 a.m. We still have no
    5 members of the public who have appeared to
    6 provide testimony and/or comment. So we are
    7 going to end this hearing.
    8 We have talked to the court reporter
    9 who has indicated she will have the
    10 transcript ready by February 25th. And we
    11 are go to close the public comment period on
    12 March 11th, 2005. I will put all this in the
    13 hearing officer order and make this official.

    14 Mr. Matoesian has indicated that he
    15 is reserving the right to file a public
    16 comment and/or closing brief, which is his
    17 right.
    18 And other than that, I don't have
    19 anything else to note. Member Johnson?
    20 MR. JOHNSON: Nothing. Thank you.
    21 MR. KNITTLE: Member Girard?
    22 MR. GIRARD: Nothing.
    23 MR. KNITTLE: So I think we are
    24 good. Of course, copies of the transcript

    1 will be available shortly after February 25th
    2 on the Board's website. That is
    3 www.IPCB.state.IL.US, as well the previous
    4 Board orders and hearing officer orders.
    5 We are not going to have another
    6 hearing on this case. And thank you all for
    7 coming.
