FACTS
1.
That
Respondent,
Knox
County
Landfill
Committee,
is the permitted
owner and
operator of Knox County Landfill #3, a facility located
in rural
Knox County, near Wataga,
Illinois.
2.
That
Respondent,
Greg
Ingle,
is the Certified Operator of the
above-referenced
fa
ci! ity.
3.
That
said
facility
is
operated
as
a
sanitary
landfill,
operating
under
Illinois
Environmental Protection Agency Permit No.
1994-105-LFM, and
is designated with Site Code No.
0958160003.
The facility is commonly known to the Illinois
Environmental Protection Agency as
Knox
County Landfill #3.

That Respondents have owned
and/or operated
said facility at
all times pertinent
hereto.

That on May 26, 2004, Jeffrey Port of the Illinois Environmental Protection Agency’s
Peoria
Regional
Office
inspected
the
above-referenced facility.
A
copy
of his
inspection
report
setting forth the results of said
inspection is attached hereto
and
made a part hereof.
VIOLATIONS
Based upon direct observations made byJeffrey Port during the course of his May 26, 2004
inspection
of
the
above-referenced
facility,
the
Illinois
Environmental
Protection
Agency
has
determined that
Respondents violated the
Illinois
Environmental Protection Act (hereinafter, the
“Act”) as follows:
(1)
That Respondents conducted a sanitary landfill operation
in a mannerwhich resulted in
refuse in standing orflowing waters, a violation of Section 21(o)(1) of the Act, 415 ILCS
5/21 (o)(1) (2002).
(2) That Respondents conducted a sanitary landfill operation
in a mannerwhich resulted in
leachate flows entering waters of the state, a violation of Section 21(o)(2) of the Act, 415
ILCS
5/21(o)(2)
(2002).
(3)
That Respondents conducted a sanitary landfill in a mannerwhich resulted in uncovered
refuse remaining from any previous operating day orat the conclusion of any operating
day,
a violation of Section 21
(o)(5) of the Act, 415 ILCS
5/21
(o)(5)
(2002).
(4) That Respondents conducted a sanitary landfill operation
in a mannerwhich resulted in
the failure to collect and contain
litter from the site by the end of each operating day,
a
violation of Section 21 (o)(1 2) of the Act, 415 ILCS
5/21 (o)(1 2) (2002).

CIVIL
PENALTY
Pursuant
to
Section
42(b)(4)
of
the
Act,
415
ILCS 5/42(b)(4)
(2002),
Respondents are
subject
to
a
civil penalty
of
Five
Hundred
Dollars
($500.00)
for each
of the violations
identified
above, for a total of Two Thousand
Dollars
($2,000.00).
If Respondents elect not to
petition
the
Illinois
Pollution Control Board, the statutory civil penalty specified above shall be due and
payable
no later than August 13,
2004, unless otherwise provided
by order of the
Illinois Pollution
Control
Board.
If Respondents elect to contestthis Administrative Citation by petitioning the Illinois Pollution
Control Board
in accordance with Section
31.1
of the Act, 415 ILCS 5/31.1(2002), and if the Illinois
Pollution Control Board issues afinding
of violation as alleged
herein, after an adjudicatory hearing,
Respondents shall be assessed the associated
hearing costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board.
Those hearing
costs shall be assessed
in addition
to the statutory
civil penalty.
Pursuant to Section 31.1 (d)(1) of the Act, 415 ILCS 5/31.1 (d)(1) (2002), if Respondents fail
to petition or elect not to petition the Illinois Pollution
Control Board for review of this Administrative
Citation within thirty-five (35) days of the date
of service, the Illinois Pollution
Control
Board shall
adopt a
final
order,
which
shall include
this Administrative
Citation
and
a finding
of violation
as
alleged
herein, and shall impose the statutory civil penalty specified above.
When
payment
is
made,
Respondents’
check
shall
be
made
payable
to
the
Illinois
Environmental
Protection
Trust
Fund
and
mailed
to
the
attention
of
Fiscal
Services,
Illinois
Environmental Protection Agency,

Affiant,
Jeff Port, being first duly sworn, voluntarily
deposes and states
as follows:

Affiant
is a field inspector employed by the Land
Pollution Control Division of the Illinois Environmental
Protection Agency and has been so employed at all times
pertinent hereto.
2.
On May 26,
2004, between 5:25 AM and 9:05 AM, Affiant
conducted an inspection of the Knox County Landfill in Knox
County,
Illinois, known as Knox County Landfill
#3, Illinois
Environmental Protection Agency Site No. 0958160003,
operating
under IEPA Permit #1994-lOS-LFM.
3.
Affiant inspected said Knox County Landfill
#3 site by
an on-site inspection,
which included walking the site and
interviewing personnel.
4.
Before and/or after said inspection of said landfill
site, Affiant reviewed Illinois Environmental Protection Agency
permits issued to the subject site and investigated into whether

or not required documents were timely filed on behalf of the
subject site.
5.
As a result of the activities referred to in
Paragraphs
3 and 4 above, Affiant completed the Inspection Report
form attached hereto and made a part hereof,
which,
to the best
of Affiant’s knowledge and belief,
is an accurate representation

Narrative
On .May 26,
2004, I (JeffPort) performed a
Solid Waste LandfillInspection
at the Knox County
Landfill #3
located in
rural Knox County,
near Wataga.
The facility is
an 814 Subpart C landfill
with
authorization
under
Permit
#1994-105-LFM
issued
on
September
29,
1994.
The
most
recent modification,
#19 was issued on November
19, 2003.
I arrived at the site at
5:25
AM.
I was accompanied by Dawn Jngold,
DLPC/FOS
Peoria.
The
entrance gate to the facility was locked but
the exit gate was open, so we proceeded through the
exit gate.
We went to
the
office but the door was locked.
We
then went
to
the maintenance
building.
Someone was working under one of the vehicles.
I asked if Mr. Ingle was present. The
man under
the vehicle said that he
was not.
I introduced myself and explained that I needed
to
perform an
inspection.
I asked the man where
the previous
day’s
active area was.
The man
directed me
to the active area.
We then proceeded to this area.

where I performed a Pre-operational Inspection.

At this location, Cell
9 intersects with Cells
4/5.
Waste has been sloughing off
from this area into the new unpermitted cell.
Leachate has also been generated in
this
area as
water
comes
into
contact
with
the
waste
and
runs
down
into
the
new
cell.
Leachate
has
accumulated in this area and can be seen in the photographs.

area, as leachate had flowed over the bermand
down
the side of the cell, impacting the water~of
the
state.
Sand had
also washed away in this
area,
exposing the
liner.
It
does not appear that
Cell
9
is
in
a
condition
to
accept
waste.
After
examining
and
photographing this
area,
an
inspection
was
performed
on
Knox
County
Landfill
#2
and
the
Compost
facility.
Those
inspections
are under their own covers.
Mr.
Ingle had joined us during the inspection for site #2.
We went to the office were I reviewed
facility records.
Mr.
Jngle
stated that the compactor had
caught on fire
on May
12 and
that the
load
checks had been stored inside it.
He sent
one of the employees to the compactor to retrieve
the load checks.
He said that the facility was operating as best as it could without the compactor,
by driving over the waste to
help compact it.
I examined the load checks that were brought back
to the office.
I also examined the load checks that had been logged in after the fire.
These items
appeared to be in order.
After further discussion with Mr. Ingle, we left the site at
9:05
AM.

inspection,
the following violations were observed and are indicated on
the accompany checklist.
