The Complainant, People of the State of Illinois,
by its attorney, James
E.
Ryan, the
Attorney General of the State of Illinois,
pursuant to Hearing Officer Order of January 23,
1998,
and
with
consent
of counsel
for the Respondent,
MIDWEST GRAIN
PRODUCTS OF
ILLINOIS,
INC.,
hereby files the following
status
report..
1.
The Complaint was filed
in this case on April 7, 1997.
2.
Since April of 1997,
Respondent has been taking
measures to correct the
emission problems at its plant.
Respondent has submitted two applications for a construction
permit for wet electrostatic precipitators and baghouse for the two dryers that are the subject of
this complaint.
Both applications were denied with reasons for the denial
by the Illinois EPA.
Respondent has submitted
a third application
for a construction permit.
The Illinois
EPA has not
yet issued a decision on that permit.
3.
The parties are in the process
of scheduling a meeting for early March,
1998,
to
discuss the issues that remain in achieving technical
compliance.
4.
It is the Complainant’s belief that
it
is in the best interest of the parties that
settlement negotiations be allowed to continue and that discovery and the hearing be
postponed.
WHEREFORE,
Complainant requests that discovery
and the hearing be postponed
in
this
matter.
